The following General Terms and Conditions govern current and future business and contractual relations between the NIT Northern Institute of Technology Management gGmbH, hereinafter referred to as the NIT, and participants in study program modules and workshops, hereinafter referred to as Customers.
2.1 Study Program
Modules are part of the NIT study program. The events held at the NIT in Hamburg, Germany, and are organized by the learning guides as agreed with the NIT's Program Team. Registration for modules is via the NIT booking tool "moNITor".
2.2 Open Workshops
Open Workshops are training events organized by the NIT and held either at the NIT or in rented facilities. They are organized by the NIT and undertaken by partners of the NIT. Registration for Open Workshops is via the NIT Box.
2.3 Closed Workshops
Closed Workshops are training events organized by the NIT and held either at the NIT or at the Customer's premises for a group defined by the Customer. The organization of the workshops, including equipment required (beamer, etc.), invitations and catering, is agreed between the NIT and the Customer.
2.4 On request the NIT makes the Customer a customized workshop offering. Offers are always made in writing and are valid for 30 days. Agreements over the telephone must be recorded in writing by the NIT and confirmed in writing by the Customer, signed with the Customer's stamp.
3.1. Study Program Modules
You can register for a module up to four weeks before its starting date or first interaction day, which can be either the first day of attendance or the first action on the NIT communication platform channel. Registration for modules starting on or from October 1 is from July 1 of that year. Registrations for modules starting on or from April 1 can be made from January 1 of the year in question.
3.2. Participation in Open Workshops at Short Notice
Subject to availability of places, short notice registrations for Open Workshops are only accepted if the bill is paid within three days of the binding booking and at least a day before the workshop begins.
4.1 Study Program Modules
Module fees include the cost of the teaching event booked and its documents, of access to the online portal and of examinations and coaching as incurred. The NIT reserves the right to adjust module charges for reasons that are beyond its control. Students who have already enrolled are not affected by any such adjustment. At the start of their studies they sign an academic contract with the NIT that specifies the program fees.
4.1.a. Enrolled Students
On receipt of the binding booking via the NIT Box the Customer will receive an order confirmation in writing. Four weeks before the start of the module (i.e. the first event date) the Customer will receive a bill for the module booked. The bill must be paid without deductions on the date(s) stated (within 14 days), stating the invoice number.
4.1.b. Non-enrolled Students
On receipt of the binding booking via the NIT Box the Customer will receive an order confirmation by e-mail. The registration will then be checked by the NIT and the Customer will as a rule receive ten days later a confirmation in writing of admission to the module. Four weeks before the start of the module (i.e. the first event date) the Customer will receive a bill for the module booked. The bill must be paid without deductions on the date(s) stated (within 14 days), stating the invoice number.
4.2. Open Workshops
Fees for Open Workshops include the cost (as a rule tax-exempt) of the event booked and the documents required. On receipt of the binding booking via the NIT Box the Customer will receive an order confirmation in writing and a bill for the event booked. The bill must be paid without deductions within 14 days stating the invoice number.
4.3 Closed Workshops
Fees for Closed Workshops include the cost (plus VAT if applicable) of the event booked and the documents required. If so agreed, the Customer will foot the bill for lunch, coffee breaks and Erfrischungsgetränke. On receipt of the binding booking the Customer will receive an order confirmation in writing and a bill for the event booked. The bill must be paid without deductions within 14 days stating the invoice number.
If the Customer is forced to cancel an event booked he must notify the NIT in writing (by mail, fax or e-mail) without delay. The date of receipt by the NIT shall apply.
5.1. Open Workshops
For Open Workshops an alternative to cancellation can, if agreed with the NIT, be a rebooking on another date. A rebooking can only be made once and the new booking must be within 12 months. The invoice will be for the original date with payment due as per the terms of payment. In the event of cancellation the following charges apply: • Cancellation up to 30 days before event's starting date: € 15.00 / max. 20% • Cancellation between 15 and 29 days before event's starting date: 50% • Cancellation within 14 days of event's starting date: 100%
5.2 Closed Workshops
As Closed Workshops are specially developed for the Customer, rebooking on another date is only possible in special cases and subject to agreement with the NIT.
In the event of cancellation the following charges apply:
5.3 Cancellation charges are offset against any advance payments already made.
6.1 NIT offers, deliveries and services are without exception subject to these General Terms and Conditions. Amendments only apply if they are agreed in writing.
6.2 NIT offers are subject to alteration and non-binding, especially where prices are concerned. The subject of an order is the performance of the module, event or other service booked and not a specific achievement.
6.3 Achievement of a qualification is only possible if a participant attends the event in its entirety. For study program modules passing the examinations is an additional qualification requirement. An event cannot be shared by several participants. A partial booking at a reduced rate is in principle not possible either unless the option is expressly mentioned in the prospectus.
6.4 The NIT is entitled to pass on parts of an order to third parties by way of a sub-authorization even without the Customer's consent.
6.5 If the NIT reserves hotel accommodation for a customer as instructed, the reservation is binding on the Customer. The Customer must notify the NIT without delay of any changes or cancellations so that it can notify the hotel, with any costs incurred to be borne by the Customer.
7.1 All modules and workshops correspond in scope and content to the module description or individual offer subject to necessary organizational changes or changes of content insofar as they do not change the overall character of the event fundamentally.
7.2 Postponement of Study Program Modules
The NIT is entitled to postpone events for reasons that are beyond its control, especially failure to reach the minimum number of bookings required or illness of the learning guides. Customers will be notified in writing without delay.
7.3 Postponement of Open Workshops
The NIT is entitled to postpone events for reasons that are beyond its control, especially failure to reach the minimum number of bookings required for Open Workshops or illness of the speaker. Customers will be notified in writing without delay. If a workshop is cancelled, any payments made will be refunded. Customers have no further claims against the NIT, especially for damages.
7.4 Postponement of Closed Workshops
The NIT is entitled to cancel or postpone events for reasons that are beyond its control, especially illness of the speaker. Customers will be notified in writing without delay. If a workshop is cancelled, any payments made will be refunded. Customers have no further claims against the NIT, especially for damages.
7.5 Withdrawal by the NIT
The NIT is entitled in principle to call off an event up to 14 calendar days before its starting date for reasons that are beyond its control. The NIT is obligated to notify the Customer without delay. The Customer will not then be entitled to make any claims against the NIT.
7.6 Cancellation by the NIT
The NIT can for good cause cancel a contract without notice. Good causes are, in particular, disruption of the course of the event, failure to abide by the House or User Rules in spite of being called upon to cease and desist, and non-payment of course fees despite receipt of a reminder to do so. The NIT reserves the right to sue the Customer for damages that it can set at a flat rate. The Customer is at liberty to prove that no damage or significantly less damage was caused. The flat-rate damages entitlement is 75% of the course fee.
The NIT reserves the right to make organizational changes. They can be changes of learning guide or of classroom within a reasonable distance from the original venue. The NIT will make every effort to notify Customers of organizational changes in good time. Failure to do so does not entitle the Customer to any right of regress.
As a matter of principle the NIT only accepts liability for damage caused by itself or its vicarious agents if it is due to gross negligence or intent. This applies especially to damage to and/or loss of Customers' property. In the event of injury to life, limb or health the NIT accepts liability in the case of simple negligence.
10.1 The NIT expressly reserves the copyright to the teacher'', learning guides' or speaker's documents, findings, calculations, etc. Documents or parts thereof may not be duplicated or made publicly available without the NIT's consent in writing.
10.2 Without the NIT's consent in writing the NIT's name or logo may not be put to further use, such as for advertising purposes on a website.
11.1 Customers' data is processed electronically for internal use. Data received during registration is stored in compliance with data protection regulations.
11.2 The Customer's name, postal address, telecommunications data and e-mail address are needed to process orders. The NIT uses personal data solely for the purpose of contractual performance. Customers are entitled at any time to information about data of theirs that is stored. The NIT treats this information as confidential and does not pass it on to third parties other than partners who need the data to process orders. We also refer you to our Data Protection Guidelines.
12.1 Should individual provisions be or become ineffective, that will not affect the overall validity thereof.
12.2 Side agreements, amendments or additions must be made in writing to be effective; the same applies to a waiver of the requirement for the written form.
The place of jurisdiction is Hamburg.
Right of Cancellation
You have the right to cancel this contract within 14 days without stating a reason for doing so. The deadline is 14 days from the date on which the contract was signed.

in a clear statement (sent, for example, by mail, fax or e-mail) of your decision to cancel this contract. If you do so we will send you without delay, such as by e-mail, a confirmation of receipt of your cancellation. You will be within the cancellation period if you notify us that you are exercising your right of cancellation before the deadline expires.
Consequences of Cancellation
If you cancel this contract we must refund all payments you have made, including shipping costs (except any extra costs arising from your choice of a mode of delivery other than the standard delivery that we offer as the lowest-cost solution), without delay and within 14 days at the latest of receipt by us of your cancellation of contract. We will refund you in the same way that you used for the original transaction unless anything else was expressly agreed with you. We will not charge you for the refund.
Your right of cancellation expires prematurely and with your consent if the contract is fulfilled in its entirety by both parties and at your express request before you exercise your right of cancellation.
